Product Overview

It is critically important for general and special education administrators to understand the educational requirements of Section 504 of the Rehabilitation act of 1973 and its applicable regulations, which prohibit discrimination against public school students solely on the basis of disability. The law mandates that all students receive a free and appropriate public education (FAPE) and an equal opportunity to participate in or benefit from non-educational activities made available by a school.

This guide examines schools’ legal requirements under the law and looks at the intersection of Section 504, the Americans with Disabilities Act (ADA), and the Individuals with Disabilities Education Act (IDEA), comparing the educational requirements of each in an accessible chart. It also touches on discipline of student with disabilities, a topic that will be examined in depth in Weatherly’s forthcoming guide, Discipline of Students with Disabilities.

Finally, it addresses common 504 non-FAPE issues and common legal remedies for 504 violations.
